Terms of Service

The service

Formwork is software that fitness studios use to run bookings, memberships and payments. It is operated by EpiHealth Solutions LLC, 11 Spring Rd, North Haven, CT 06473. Each studio is the business its members deal with: the messages a member gets, the classes they book and the payments they make are the studio’s, sent and processed through Formwork on the studio’s behalf.

By creating an account or using Formwork you agree to these terms. If you do not agree, do not use it.

Accounts

Give accurate information, keep your password to yourself, and tell us if you think your account has been used without you. You are responsible for what happens under your account.

Studios and payments

The studio, not Formwork, is who you buy from. Classes, prices, memberships, credits, cancellation rules and fees are the studio’s. Payments go through the studio’s own Stripe account, and refund or billing questions go to the studio first.

Acceptable use

Do not:

• break the law or use Formwork to harm anyone;
• try to get into accounts or data that are not yours;
• interfere with or overload the service;
• book classes or use credits in a way the studio’s rules do not allow.

Text messaging (SMS) terms

Program: Formwork sends transactional text messages on behalf of the studio you belong to. The messages are: waitlist spot-opened alerts, notices that a class you are booked into was cancelled or rescheduled by the studio, notices that a studio fee could not be charged or needs one more step to confirm, and account verification codes.

How you opt in: text alerts are off by default. In your account, under Notifications, you verify your mobile number and then switch on Text alerts. You are shown the consent wording and must confirm by choosing Turn on text alerts. Consent is not a condition of purchase.

Message frequency varies with your activity, such as your bookings and waitlists.

Msg & data rates may apply.

To opt out, reply STOP to any message, or turn off Text alerts in your account. After you opt out you will not get more alert messages from us.

We do not send alert texts between 9 PM and 8 AM in the studio’s local time.

Mobile numbers and text-message opt-in data are not shared with third parties or affiliates for marketing or promotional purposes.

Availability and changes

We work to keep Formwork running but do not promise it will always be available or error-free. We may change or stop parts of the service, and we may update these terms; the date at the top shows the latest version.

Disclaimer and liability

Formwork is provided as is, without warranties beyond those the law requires. To the extent the law allows, we are not liable for indirect or consequential losses arising from use of the service. Nothing here limits liability that cannot be limited by law.
